Annual Leave



Applies to: all NLG Team Members

Introduction

Team members will be entitled to paid holidays in line with the Holidays Act 2003 and its amendments. 

Annual Leave Entitlement

Unless otherwise agreed, after the completion of each year of continuous employment with Noel Leeming Group Limited a team member will be entitled to four (4) weeks annual holidays. 


Taking Annual Leave

Except where the employment agreement otherwise provides, the time at which any annual leave may be taken will need to be approved by the manager, after receiving a formal application (electronically or in writing) from the team member.

In approving the time for the annual leave, regard shall be given to time, work requirements and the opportunities for rest and recreation available to the employee. Under the Holidays Act, team members will be given the opportunity to take at least two weeks annual leave continuously, if they wish to do so, and the third and fourth week at a mutually agreed time if taken separately.


Taking Holidays within 12 months

The Company requires that holidays be taken within 12 months of falling due. Where holidays are not taken within 12 months of falling due, a team member’s Manager may direct the employee to take such holidays.


How and When To Apply

A Leave Application Form must be completed in MyPay and submitted to the Manager for approval.  Sufficient notice (minimum of four weeks) should be given when requesting leave. 


Management of Excessively Large Leave Balances

Noel Leeming Group will be required to take action for those staff who have excessively large leave balances.  The options in order of preference are:

1.         Ask the team member to take a period leave as soon as possible, or

2.         Ask the team member for a leave calendar detailing how much leave they will take in the next six months.

3.         If no agreement can be reached, NLG may issue 14 days notice requiring the employee to take leave at a time that suits the business.


Cashing up of Annual Leave

Requests to "cash-up" the fourth week of entitled leave, in accordance with the Holidays Act 2003, will be considered by the Company on a case by case basis and should be discussed with your Manager.  Team members can view their cash-up balance on MyPay: My Details: "Annual Leave 4th week Cashup". All requests must be made by the team member via   MyPay: My Transactions:  “Annual Leave 4th week Cashup”.  Team members may request to cash up one day or several days up to the value of one (1) usual working week and only one request per year will be considered. 


Termination

On termination of employment, all remaining annual leave will be paid out.

If you have taken in excess of your accrued leave entitlement, then this will be deducted from your final pay.


Employer-Related Holidays

Any time off work on employer-related incentive holidays will be counted as annual leave.
